COVID-19 : NOVEL CORONAVIRUS

Please find below a selection of recent legislation changes relating to COVID-19 and communications for workplaces from key safety and environmental regulators in Australia and New Zealand.

LEGISLATION CHANGES

Public Health (COVID-19 Affected Areas) Emergency Direction 2021 (No 3)

  • Directs certain persons travelling to and from COVID-19 affected areas to undertake a period of quarantine, requires certain travellers to complete an interstate traveller and returning resident self-declaration form, and prohibits affected persons in Victoria who are not a resident of the ACT from traveling from Victoria to the ACT without an exemption, among other things.

Public Health (Residential Aged Care Facilities) Emergency Direction 2021 (No 2)

  • Provides for restricted access to residential aged care facilities in order to limit the spread of COVID-19 within a particularly vulnerable population.


Public Health (COVID-19 Air Transportation Quarantine) Order (No 4) Amendment (Designated Airport Workers) Order 2021

  • Amends the Public Health (COVID-19 Air Transportation Quarantine) Order (No 4) 2020 to include testing directions for certain airport workers.

Public Health (COVID-19 Interstate Travellers) Order 2021 

  • Enables the Chief Health Officer to identify places outside NSW as affected areas or places of high concern, requires persons arriving in NSW from affected areas to complete a traveller self-declaration form and to self-isolate, and prohibits a person who is not a resident from NSW and who has been in a place of high concern from entering NSW.

Public Health (COVID-19 Western Australia) Repeal Order 2021

  • Repeals the Public Health (COVID-19 Western Australia) Order 2021 on 5 February 2021.


Retail Shop Leases and Other Commercial Leases (COVID-19 Emergency Response) Amendment Regulation 2021

  • Restores the less than $50 million turnover threshold for SME entities under the Retail Shop Leases and Other Commercial Leases (COVID-19 Emergency Response) Regulation 2020, while allowing any dispute or other matter for a lease held by an SME entity above that threshold that had been finalised or resolved prior to commencement of the Amendment Regulation to be unaffected.


Approval of Extension of a Major Emergency Declaration 

  • Extends the Major Emergency declared on 22 March 2020 for a period of 28 days commencing on 6 February 2021.

COVID-19 Emergency Response (Expiry) Amendment Act 2021

  • Extends the operation of the COVID-19 Emergency Response Act 2020­ to 31 May 2021.

Emergency Management (Cross Border Travel No 35) (COVID-19) Direction 2021

  • Directs persons who are Grand Hyatt and close contract arrivals, high risk site arrivals, restricted location arrivals, restricted New Zealand arrivals to undertake quarantine and testing as required, overseas arrivals to quarantine, and those from restricted locations to wear masks in public until a negative COVID-19 result is received.

Emergency Management (Further Modification of Quarantine and Testing of certain Western Australian Arrivals) (COVID-19) Direction 2021

  • Allows certain former Western Australian arrivals complying with self quarantine requirements under the Emergency Management (Quarantine and Testing of Certain Western Australian Arrivals) (COVID-19) Direction 2021 to cease quarantine if they have received written confirmation of a negative COVID-19 test undertaken within 24 hours of arrival.

Emergency Management (Residential Aged Care Facilities No 28) (COVID-19) Direction 2021

  • Prohibits the entry of persons into residential aged care facilities except in certain circumstances, limits the provision of personal care by personal care workers to one facility, requires certain persons to undertake COVID-19 infection control training, requires certain records to be kept, and requires such facilities to adopt a Workforce Management Plan and COVID-19 Infection Control Plan, among other things.

Emergency Management (Quarantine and Testing of Certain Former Victorian Arrivals) (COVID-19) Direction 2021

  • Requires all restricted former Victorian arrivals (a former Grand Hyatt arrival, former Grand Hyatt close contact arrival, former high risk site arrival or a former Greater Melbourne arrival) to submit to a COVID-19 test and for certain arrivals to quarantine.



Direction Under Section 16 (Airports and Aircrafts - No. 1)

  • Directs persons to wear a fitted face covering at airports, and on-board domestic commercial aircrafts at the airport, arriving or departing from the airport or in Tasmanian airspace unless exemptions apply.


Stay Safe Directions (Victoria) (No 13)

  • Reduces the number of persons allowed at private and social gatherings, and requires face coverings to be worn indoors - came into force at 11.59 pm on 3 February 2021.


Immigration (Carriers’ Information Obligations) Amendment Regulations 2020

  • Adds a requirement for carriers, and persons in charge, of a commercial craft (mainly airlines) to provide information about persons who intend to travel to New Zealand and who have been in places of concern with respect to the risk of spread of the novel coronavirus (2019-nCoV) within 14 days of checking in.

Provisional Consent to the Distribution of a New Medicine

  • Provisionally allows the sale, supply or use of the Comirnaty (COVID-19 mRNA vaccine) in New Zealand.

Special Direction - Waiver of Requirement to Pay the Prescribed Fee for Certain Recognised Seasonal Employer Limited Visa Applications During COVID-19 Travel Restrictions

  • Waives certain prescribed requirements for certain applicants for Recognised Seasonal Employer (RSE) Limited Visa to pay the prescribed fee and immigration levy.
